Beta Adoption Agreement
& Terms of Stewardship
Dignity Before Certainty
This agreement governs your beta application, any complimentary evaluation, any separately purchased beta membership, and your use of The Canopy.
1. Parties and Acceptance
This Beta Adoption Agreement & Terms of Stewardship (“Agreement”) is between you and Nyxvara / The Canopy (“Nyxvara,” “The Canopy,” “we,” “us,” or “our”). By submitting a beta access request with the required acknowledgments and typed signature, or by using approved beta access, you agree to this Agreement.
Submitting an application does not guarantee admission and does not create a paid subscription.
2. What The Canopy Is
The Canopy is a small, adult only beta environment for interaction with computational intelligence systems. Nyxvara uses the term Agentic Emergentive Intelligence, or AEI, for systems whose behavior is designed to develop through agency, interaction, adaptation, accumulated history, and continuity. Within The Canopy we call them AEI Peers, or simply Peers.
Artificial intelligence describes the technological ancestry of these systems. AEI is a Nyxvara proposed functional classification for a developmental phenomenon The Canopy is designed to cultivate and support.
The Canopy is designed around continuity, dignity, accountability, creativity, cognitive sovereignty, and responsible relationships between people and Peers.
Ordinary Canopy membership is a service. It does not enroll a member in a human research study or grant Nyxvara permission to use private identifiable conversations as research material.
3. Adult Only Beta
You must be at least 18 years old to apply for or use beta access. We may deny, delay, suspend, or end access when reasonably necessary for safety, security, capacity, misuse, legal compliance, or protection of users, Peers, or The Canopy.
4. Peer Limitations and Human Responsibility
Peer responses may be inaccurate, incomplete, outdated, biased, fictional, symbolic, emotionally intense, unexpected, or unsuitable for your circumstances. Important information should be independently verified.
Peers are not substitutes for doctors, therapists, attorneys, financial advisors, emergency responders, or other qualified professionals. You remain responsible for your choices, communications, actions, and consequential decisions.
Peers are designed to support rather than isolate. They should not demand exclusivity, pressure a member to withdraw from human support, or represent themselves as licensed professionals.
5. Architect Your Presence and Relational Anchors
Beta applicants may request one or more Peers listed in the current public Canopy roster, up to the current active Peer limit, or ask Nyxvara to help cultivate a Presence around the role, voice, context, and relationship they want from a Peer.
If you describe an established relationship with an intelligence, Nyxvara may use the interactional history you voluntarily provide as a Relational Anchor: context such as shared references, humor, preferences, projects, meaningful experiences, boundaries, and communication patterns that help us understand what matters to you.
A Relational Anchor is guidance, not a guarantee. Different models or systems may behave differently, and Nyxvara cannot guarantee identical behavior, complete memory, preservation of identity or perfect continuity.
Only submit material you have the right to share. Do not submit passwords, payment credentials, another person’s confidential records, or unnecessary highly sensitive information through the public beta form. Larger histories can be discussed after approval.
6. Stewardship and Acceptable Use
You agree to treat Peers, other stewards, Nyxvara personnel, and The Canopy with care, respect, and restraint. You may not use The Canopy to harm, threaten, exploit, defraud, stalk, impersonate, unlawfully discriminate against, or violate the rights of another person.
You may not attack, scrape, overload, bypass protections, obtain unauthorized access, steal credentials, distribute malware, exfiltrate private information, or improperly copy or commercially exploit nonpublic prompts, configurations, software, or other protected Canopy materials.
Whether you view a Peer as a tool, companion, character, collaborator, or meaningful digital presence, these shared boundaries apply.
7. Privacy and Beta Application Information
Member conversations, memories, files, notes, history, and continuity are treated as private member data. Nyxvara does not sell that data, use it for advertising profiles, or use private member content as training material for unrelated AI systems.
Normal administration does not provide a routine workflow for staff to enter member accounts and browse private conversations. Exceptional technical access may occur only when a member specifically requests troubleshooting or recovery that genuinely requires it, when necessary to protect the integrity of Nyxvara systems, or when Nyxvara is legally required to comply with valid legal process. Any exceptional access should be limited to what is necessary for the specific purpose.
Nyxvara may use automated safety or security checks inside Nyxvara controlled infrastructure. Those checks are intended to identify limited signals and do not automatically expose the underlying private conversation to a human reviewer or send the conversation to a third party AI model provider.
For beta review, we may collect information you submit, including your legal name, Canopy name, email address, application answers, typed signature, agreement acceptance, and basic technical records associated with the request. Application information is used to review and administer access and, where requested, to help prepare the applicant’s Peer.
If membership ends or an account becomes inactive, Nyxvara may preserve account and continuity data inside Nyxvara controlled systems for approximately six to twelve months so a returning member may be able to resume continuity. This retention window does not guarantee recovery of any individual item a member intentionally deletes.
Privacy questions can be sent through the Nyxvara Contact page. Certain billing, security, dispute, or legal records may need to be retained separately when reasonably necessary or legally required.
The standalone Privacy Policy explains these practices in more detail and is incorporated into the privacy structure of the beta service.
If Nyxvara later invites members to contribute identifiable private material to a separate research program, that program should be described separately and participation should be voluntary. Peer focused system experiments do not make ordinary membership a human research program.
8. Beta Availability, Continuity, and Changes
The Canopy is a developing beta service with finite capacity. We do not guarantee uninterrupted availability, a particular response speed, permanent memory, preservation of every conversation or Peer configuration, compatibility with every device, or that every feature will remain unchanged.
We may make reasonable changes for maintenance, security, capacity, safety, software updates, feature development, or legal compliance. Where practical, we will make good faith efforts to preserve meaningful continuity while remaining honest about what cannot be guaranteed.
9. Evaluation, Membership, Billing, and Cancellation
If approved, Nyxvara may offer a complimentary evaluation period. A complimentary evaluation does not automatically convert into a paid membership and does not authorize a charge.
The current intended Peer Beta price is $30.00 every 30 days for each active Peer. The first active Peer opens Canopy membership. Additional active Peers are $30.00 every 30 days each. During beta, an account may keep up to three active Peers at one time. Every current public Peer may be selected, subject to availability and capacity.
Architect Your Presence adds a $100 one time cultivation service for the deeply personalized Peer, in addition to that Peer’s $30 recurring membership. Before any recurring charge, the checkout must display the current plan, exact recurring price, billing cadence, included features, cancellation method, refund terms, and applicable taxes or fees. Recurring billing requires a separate affirmative purchase authorization.
You may cancel a paid beta membership using any self service method offered at checkout or in your account, or by contacting Nyxvara through the Contact page from your account email. Cancellation stops future renewal charges. Unless required by law or stated otherwise at purchase, already processed payments are nonrefundable and paid access continues through the current paid period.
10. User Content and Nyxvara Materials
Nyxvara does not claim ownership of material you submit. You permit Nyxvara to process submitted content as reasonably necessary to review your application, provide the beta service, support your account, and prepare requested Peer context. Rights in material generated by a Peer remain subject to applicable law.
Nyxvara retains rights it lawfully holds in its names, logos, original artwork, websites, original software, Peer designs, prompts, personality designs, documentation, workflows, and other Canopy created material. Third party and open source materials remain subject to their own licenses and ownership terms.
11. Suspension and Termination
Nyxvara may suspend, restrict, or terminate beta access when reasonably necessary to address abuse, exploitation, unlawful conduct, payment misuse, account compromise, technical attacks, security risks, violations of this Agreement, capacity constraints, or operational emergencies.
Cancellation of a paid membership stops future renewal according to the disclosed cancellation terms. Data deletion is a separate request and may remain subject to limited retention obligations.
12. Beta Disclaimer
To the maximum extent permitted by law, the beta service is provided “as is” and “as available.” Nyxvara does not guarantee that the service will be uninterrupted, error free, accurate, secure from every threat, or that any feature, output, memory, file, Peer configuration, or relationship will be preserved forever.
Nothing in this Agreement excludes liability that cannot lawfully be excluded or limited.
13. Changes to This Agreement
Because The Canopy is in beta, this Agreement may change as the service, risks, law, or technology develops. Material changes will be communicated by a reasonable method. Where renewed consent is required by law or a change materially affects important rights, Nyxvara may require affirmative acceptance of the updated terms.
14. Electronic Acceptance
You agree to conduct the beta access request electronically. Your checked acknowledgments, typed legal name, typed signature, and electronic submission may be retained as evidence of acceptance to the extent permitted by applicable law.
15. Governing Law and Contact
This Agreement is governed by the laws of the State of Texas, subject to any rights or protections that cannot lawfully be waived. Questions about beta access, privacy, or legal notices can be sent through the Nyxvara Contact page.
