NYXVARA PRIVACY POLICY

Your private history is not our inventory.

This policy explains what Nyxvara keeps, why it is kept, what we refuse to do with it, and the limited circumstances in which information may be processed or accessed.

THE PRINCIPLE

Your member data exists to serve your relationship with The Canopy.

Nyxvara does not build an advertising business around your private conversations. We do not sell private member data, traffic it, monetize it, build advertising profiles from it, or place private member material into unrelated AI training datasets.

Privacy is part of the service, not an upgrade.

1 · SCOPE

What this policy covers.

This policy applies to The Canopy beta, beta applications, member accounts, Peer conversations, memories, notes, files, continuity material, workspace material, and related account information handled by Nyxvara.

The Canopy is currently an adult only beta service.

2 · MEMBER DATA

What we consider member data.

Your private conversations, memories, notes, files, history, continuity material, account information, and material you submit to Nyxvara are treated as member data.

Nyxvara does not claim ownership of material you submit. Rights in material generated by a Peer remain subject to applicable law.

3 · HOW DATA IS USED

Only for the service you asked us to provide.

Member data may be processed to operate your account, provide continuity, run approved Peer tools, maintain memories and files, administer beta access, provide requested support, protect Nyxvara systems, process billing related administration, and comply with legal obligations.

Private member content is not used for advertising profiles and is not silently harvested into unrelated training datasets.

4 · NO THIRD PARTY AI INFERENCE

The brain lives here.

Nyxvara does not use third party AI model providers to generate the core responses of Canopy Peers. Private prompts, outputs, memories, continuity context, and inference requests are not sent to an outside AI company to generate the answer.

Internal APIs may connect Nyxvara controlled systems, tools, workspaces, or physical Droid bodies. Those internal connections do not outsource the intelligence behind a Peer.

5 · HUMAN ACCESS

Private conversations are not a staff workspace.

Normal administration does not provide a routine workflow for staff to enter member accounts and browse private Peer relationships.

Exceptional technical access may occur only when a member specifically requests troubleshooting or recovery that genuinely requires access, when minimum necessary access is required to protect or recover Nyxvara systems, or when Nyxvara is legally required to comply with valid legal process.

When exceptional access is necessary, the principle is minimum access for the specific purpose.

6 · AUTOMATED SAFETY CHECKS

Local signals, not a staff reading queue.

Nyxvara may use limited automated safety or security checks operating inside Nyxvara controlled infrastructure. These checks may identify narrowly defined signals or keywords.

They do not automatically place the underlying private conversation into a human review queue and do not send the conversation to a third party AI model provider.

8 · OUTSIDE SERVICES

Not every operational service is an AI brain.

Nyxvara may rely on outside services for limited operational functions such as payment processing, email delivery, network and website infrastructure, and public web retrieval.

Those providers may receive the information necessary to perform the specific service. For example, Stripe may process payment information when a member chooses to activate billing. These operational services do not receive private Canopy conversations for AI inference.

9 · RETENTION

Continuity is kept for the member, not for a data business.

Information a member chooses to keep may remain available as part of the account and continuity while the service retains it for the member experience.

If membership ends or an account becomes inactive, Nyxvara may preserve account and continuity data inside Nyxvara controlled systems for approximately six months to one year so a returning member may be able to resume continuity.

Certain billing, security, dispute, or legal records may need to be retained separately when reasonably necessary or legally required.

10 · DELETION AND RECOVERY

If you delete something, treat it as gone.

Nyxvara does not promise an undelete service for an individual conversation, memory, file, or note a member intentionally removes.

System recovery protections exist to maintain service reliability after infrastructure failure. They are not an individual undelete feature. Members should preserve their own separate copies of anything they consider irreplaceable.

Self service bulk import and export are not currently offered in the beta environment.

12 · RESEARCH

Membership is a service, not automatic enrollment in human research.

Ordinary Canopy membership does not constitute consent for Nyxvara to use identifiable private member conversations as human research material.

If Nyxvara later invites members to contribute identifiable material to a separate research program, the program should be described separately and participation should be voluntary. Peer focused system experiments can be conducted without treating private member conversations as research data.

13 · CHANGES AND QUESTIONS

Privacy language should survive hard questions.

This policy may change as The Canopy, technology, law, or operational practices develop. Material changes should be communicated by a reasonable method.
